The controversy generated by the arduous working conditions of "riders" (home delivery workers from platforms such as Glovo or Deliveroo) and other groups under the protection of digital platforms has been a topic of conversation for several months. As a result of the pandemic, the protests of these workers intensified, especially after the reduction of the base salary rate of 50% (from 2.5 to 1.2 euros) imposed by Glovo. Just yesterday, the Minister of Labor Yolanda Díaz presented the agreement reached with the employers and the unions for approval in the Council of Ministers, coinciding with various protests by the group that filled the main cities of the country, riding motorcycles and bicycles.
Basically, the new decree aims to eliminate the condition of “false self-employed” to which workers have been benefiting until now . Upon approval, riders who provide delivery services through digital platforms must count Phone Number List as salaried employees. Companies will have a period of 90 days to formalize the contract, although from the moment the decree is approved, workers would already be “labor personnel” and would benefit from the rights that this implies. In the words of Yolanda Díaz, workers “will enjoy all rights, they will pay contributions for them and they will enjoy the entire chain of social protection.” Only the “riders” are protected by the law Although many celebrate the achievement of this agreement, certain workers have been left out of it.
Specifically, the decree would only affect those people who provide "paid services consisting of the distribution or distribution of any consumer product or merchandise." This means that workers immersed in the same work model but who perform other tasks, such as custom translations or home cleaning , will continue in the same jobs. The Riders X Rights collective has publicly expressed its disagreement precisely on this point. Unions would have access to algorithms The decree also contemplates that the representative forms of the workers of each company can access the part of the algorithm of the digital platform that affects them at work. This point does extend to all types of people, whether they are riders or not.
